As Ghana prepares for its general elections on December 7, 2024, the importance of judicial independence and integrity has been underscored by Prof. Samuel Ato Duncan, President General of the Center of Awareness Global Peace Mission and Founder/CEO of COA Research and Manufacturing Limited Company, and chairman of the 50th Anniversary of the Judicial Service Staff Association of Ghana (JUSAG).

Addressing the gathering at the JUSAG anniversary celebration held at the University of Cape Coast, Prof. Duncan emphasized the vital role of independent and impartial judges in addressing electoral disputes and building trust among citizens, candidates, and political parties.

“Judicial independence and integrity are essential for ensuring peaceful elections in Ghana,” Prof. Duncan stressed. “Independent judges are necessary for effectively addressing electoral disputes, reducing the likelihood of violence or unrest, and maintaining the legitimacy and credibility of the electoral process.”

Prof. Samuel Ato Duncan identified three crucial factors influencing judicial independence, including separation of powers, impartiality, and security of tenure. He explained that a clear distinction between the judiciary, legislature, and executive is essential to prevent interference in elections. Additionally, judges must avoid conflicts of interest to ensure fair decision-making, and have secure positions to prevent political manipulation or intimidation.

The renowned professor also stressed the significance of regional and international support in promoting judicial independence. Organizations such as regional economic communities, the African Union, and international bodies can provide technical assistance, training, and observation missions to strengthen the judiciary.

With the National Democratic Congress (NDC) and New Patriotic Party (NPP) already solidifying their positions, a fair and impartial judiciary will play a critical role in resolving electoral disputes and maintaining peace. Ghana’s electoral landscape is expected to be highly competitive, and the judiciary’s independence will be crucial in ensuring a peaceful and credible electoral process.

As Ghana inches closer to the 2024 general elections, the importance of judicial independence and integrity cannot be overstated. By prioritizing these principles, Ghana can ensure a peaceful and credible electoral process.
